General Terms and Conditions (GTC)
Here are the general terms and conditions of Art Design Anna Janas. We have written them in German, Polish, and English so that you can easily understand them. If you still have questions, please feel free to contact us. We are happy to answer your questions.

§ 1 Scope of Application
This clause states that the present general terms and conditions apply to all contracts between the company Art Design Anna Janas, Bischofswerdaer Str 1, 01920 Elstra (hereinafter referred to as "Art Design") and its customers in the currently valid version.
§ 2 Conclusion of contract
The offers made by Art Design are non-binding and are subject to availability of goods from Art Design's suppliers. The customer places an order by either submitting the fully completed online order form or by providing the complete order details by post or phone. The customer is bound by their offer, which they have made by submitting their order.
The presentation of products in the Art Design online shop does not constitute a binding contractual offer, but rather a non-binding online catalog. The confirmation of receipt of the order occurs immediately after the order has been sent and does not yet constitute acceptance of the contract. We can accept your order within two days by either sending an order confirmation by email or delivering the goods.
§ 3 Title reservation
This legal text states that the goods sold by Art Design remain the property of Art Design until full payment has been received.
§ 4 Offsetting
According to this section, the customer is only allowed to set off claims that have been legally established, are ready for decision in a judicial procedure, or are undisputed. The customer only has a right of retention if they have claims from the same contractual relationship.
§ 5 Prices
According to this clause, the prices stated at the time of ordering apply. However, Art Design reserves the right to change the prices stated in the catalog or online shop at any time. All prices for goods or services include the value-added tax applicable in Germany at the time of ordering.
§ 6 Payment
According to this clause, the customer will receive an invoice together with the delivered goods. Payment is due without deduction within 14 days of receiving the invoice. There are various payment options:
Direct debit payment: The payment will be automatically debited from your account.
Invoice payment: You pay the invoice amount within the payment deadline after receiving the invoice.
If you are in default, Art Design reserves the right to charge you default interest in accordance with §§ 288, 286 BGB.
Credit card: Your credit card account will be charged when the goods are shipped.
Advance payment: You pay the invoice amount in advance and receive the goods after receipt of payment.
PayPal: You pay the invoice amount via PayPal.
- Giropay: You pay the invoice amount via Giropay.
- Klarna: You pay the invoice amount via Klarna.
For customers abroad, Art Design only accepts credit card, PayPal and advance payment. Art Design reserves the right to accept only payment by credit card or advance payment for new customers or in special cases.

§ 8 Right of cancellation
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period shall expire 14 days from the day on which you or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To exercise the right of withdrawal, you must inform us (Art Design Anna Janas, Bischofswerdaer Str. 1, 01920 Elstra or by email: info@artdesign-elstra.de) of your decision to withdraw from this contract by an unequivocal statement. You may use the Model-cancellation form provided on our website, but it is not obligatory. We will communicate to you an acknowledgement of receipt of such a withdrawal without delay. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. We will bear the cost of returning the goods within Germany. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer's specifications or are clearly personalized, nor to goods which are liable to deteriorate or expire rapidly, or to sealed audio or video recordings or computer software, if the seal has been broken after delivery.
§ 10 Processing of returns
Please pack the goods carefully for transport, ideally as you received them. To facilitate the processing of your return, please also fill out the enclosed return form and include it with the shipment. If you would like to make a return, please let us know by calling us at +49 (0) 1522 394 8888 or emailing us at info@artdesign-elstra.de You also have the option of having us pick up the goods. However, please note that this procedure is not necessary to exercise your statutory right of withdrawal.

§ 11 Wrong delivery
If it is a wrongly assembled delivery or a faulty product, Art Design will cover the cost of the return shipment. Please provide the order number and the reason for the return in this case, so that Art Design can arrange for the pickup of the product.

§ 12 Liability
Art Design is not liable for damages resulting from the breach of ancillary obligations. An exception to this is damages caused by grossly negligent breach of duty by Art Design, its organs, legal representatives, or agents. Art Design is also liable for damages resulting from the violation of life, body, health or the violation of a material contractual obligation. Exclusions of liability do not apply to damages caused by intentional or negligent breach of duty, including the direct liability of Art Design's organs, legal representatives, and agents.
§ 13 Youth Protection Act
If you order goods that are regulated by age restrictions, we ensure that the buyer has reached the required minimum age by using a reliable procedure that includes a personal identity and age verification. The delivery person will only hand over the goods to the buyer personally if the age verification has been successfully completed.

§ 15 Dispute settlement procedure before a consumer arbitration board
The following information on online dispute resolution is available: The European Union's platform for online dispute resolution provides a point of entry for the out-of-court resolution of disputes related to online purchase contracts. You can access the platform at http://ec.europa.eu/consumers/odr/ Art Design is willing to participate in out-of-court dispute resolution procedures with a consumer arbitration board, but not obligated to do so. However, if Art Design were obliged to participate in such a procedure, it would inform the customer accordingly.
